Information about europeian measures and education of the European Law on the Police Academy of Czech Republic in Prague

1. Programme of the study subject European law

1.1 Lessons of the European law are provided on the CR Police Academy since 1998 - originally as semester study on Bachelor level. Basic and concept document for providing of the so called process of Europeanisation on CR Police Academy, it is the decision of the Council for Science of the CR Police Academy from March 30, 1998 that approved the material "Share of CR Police Academy in preparation of the Ministry of Interior and CR Police for entry into European structures".

According to concept material, the programme of Europeanisation should be elaborated into teaching curricula of individual subjects and scripts. It means that the lessons of these subjects, their basis relates to problems of European Union (EU) should be accepted and taught with the view of European law and European standards. It means to elaborate in necessary framework Schengen, Europol, Dublin, Eurojust, EU Treaty on legal assistance in criminal matters, and other subjects and documents of acquis justice and internal affairs into particular specialized subjects.

CR Police Academy has professional "security and law" direction and under this direction is managed even the contents, framework, and organization of lessons. Lessons of European law are provided by one teacher and it is included in the Department of public and legal disciplines, together with constitutional law and theory of law.

1.2 Since October 2000, Magister study has been introduced in the CR Police Academy and within this framework, the examination subject "European law" is included. In a parallel way, under the name European law, the lessons aimed at interior and justice continue also on the level Bachelor study that ends with unit credit. Since September 2003, the subject International and European law will be introduced and will be aimed at administration of the state and local governments as an examination subject for Bachelor study.

It is a one semester study - in case of presence Magister study, it is a last year of the study in a total of planned 3 hours per week (from that one hour seminar) - and further 2 hours per week for Bachelor presence study in the second year. Combined types of both forms of study do have 13 hours of lessons. Students of Magister level meet during two semesters with the lessons of European law, because Magister study follows after Bachelor study.

For the aim of European law study on Magister level, the curriculum and share of lessons has been added and made deeper - it is not only specialization for the area of justice and internal affairs but also the basis of wider general theory mainly of the European communautaire law, history questions and EU genesis, new EU legal institutes as joint investigation teams, Eurojust, or European warrant of arrest, etc.

Programme of lessons and English translation of the above mentioned subjects, is submitted.

In a parallel way, lessons of new subject have "Basis of international public law" have been introduced for Bachelor degree and later on even for Magister degree, that ends with unit credit. Knowledge of international public law basis is thus necessary even for the study of the European law.

1.3 Programme of the subject European law and its modification respects the direction of the CR Police Academy as "security and law" higher study institution. From this reason, the themes of the lessons are divided into four following main directions (groups):

a. General questions of the European Union (history, genesis of integration processes).
b. General theory of the European law and EC/EU matters.
c. European law aimed at the area of justice and internal affairs, legal approximation, Union standards.
d. Internal and external security, public order, basis of Union´s civil protection and crisis management, cooperation in criminal matters within Union and matters of basic rights protection.

Attention is paid, from the point of the wide and deepness, especially to the last two groups. Academy has today at its disposal sufficient amount of teaching texts and aids of its own provenience.



2. Providing of lessons through teaching texts

Textbooks of European law of the faculties of law and from other higher educational institutions in CR, publications for Union´s problems and other professional texts - collected continuously from the EU Information Centre in Prague are available for the need of detailed study and elaboration of diploma and Bachelor dissertations. Concerning these problems, good quality foreign language literature exists together with translation of documents and some publication and international legal regulations exist in the Academy. Academy´s own publication activity is also fully used for thee questions of European Union.

It is possible to say that it has been managed in a short time to fully arrange the teaching texts for the lessons of European law and especially for the specialization in the area of justice and internal affairs, and this was done by the following teaching scripts and monographs of the author Bohumil Pikna:

Professional form of the European law learning text elaboration aimed at the area of justice and internal affairs as a complex textbook doesn´t exist in any member European union country, and even in any associated country. These lessons are based in these countries on the "sector" access, i.e. the lessons or the publishing in professional magazines, is aimed at individual professional subjects and not at the science and pedagogy inter-disciplinary basis - as it is in the case of these problems elaboration for the aim of CR Police Academy.



3. Europeanisation measure towards teaching of further subjects

For the aim of necessary Europeanisation in the lessons of subjects to be taught - where it is possible - particular measures have been accepted with the use of application method of the European law theory and European standards for particular curricula of legal, managerial and other disciplines. Contents and the way of new texts elaboration on the Academy has been subordinated to this task.

Concerning these activities and measures, it is possible to mention as an example the following:

In this relation, it is possible to remember proved practice when to the process of elaboration of diploma and Bachelor dissertation not only the acknowledged professionals from the practice (indirectly) are engaged - as consultants. In this way, the Academy is arranging continuously the immediate and necessary contact with practice including further contact mainly on the Ministry of Justice, Ministry of Finance - General Directorate of Customs.

In preparation of diploma and final dissertations, it is followed that the subject of this work is evaluated from the point of European law and particular EU standards. Especially in the last time, we do succeed to fulfil this task and the students express high interest for the lessons of European law and even for elaboration of final and diploma dissertations concerning EU theme. Question of elaboration of the European law and EU standards into these works is also important aspect of evaluation their quality in a case when the problems concern EU matters.



5. Application of Internet (Intranet possibilities for the aim of the European law study assistence

In cooperation with the department of information technologies, since January 2002, on the Internet (Intranet) page of the CR Police Academy there is special "Internet (Intranet) page of PA CR ("European law" ) http://www.mvcr.cz/akademie/ eu/index.html. The main aim of this Internet (Intranet) page is to add and amend the existing learning texts of the European law. It introduction is a flexible reaction mainly as to cumulation of lessons in four courses (total 400 students) in one winter semester 2002 with the aim to provide necessary teaching materials for all students. On this Internet (Intranet) page, there are and continuously will be published still more often also the articles of professionals from the practice and there is also an important part concerning the methodology of the work with the European law texts with the possibility of direct entry actually into all important international and local Internet matters containing the particular matters including the access to the originals and translations of legal EC/EU acts (in Czech language).



6. Introduction of library with publcations on EU and advertisement of EU

In March 2002, special place has been determined for particular materials in the room of science library. It contains publications and materials on EU issued in the framework of "communication strategy before entry CR into EU" under auspices of MFA under EU warranty. Several dozens of different publications are at disposal in sufficient number of exemplars in such a way that the students and teachers and other employees of the Academy can get them free of charge. Publications are continuously changed and amended especially from the fond of EU Information Centre in Prague.

In July 2001, there has been realized in relation to the advertisement of EU matters the following:



7. External activities of the Academy

The Academy has arranged in 2000/2001 the lectors in ten courses in the Academy area and the education for approx. 700 employees of the Ministry of Interior and CR Police relating to problems of European Union. The participating departments hade at their disposal free of charge approx. 200 pcs of mentioned text scripts of the Police Academy - European law aimed at justice and internal affairs what was elaborated in the framework of the grant. Departments of CR Police and Ministry of Interior have got free of charge also 500 pcs of later publication of the above mentioned text scripts Documents with commentary for the study of European law (20001) that have published on EU expenses.

Every year, the CR Police Academy is providing within the life-long education for employees of the MI and CR Police one-day courses for 30 - 60 people, including teachers of Police Schools. As above standard possibility, the training of specific themes for intelligence services members is provided several times per year.

The departments are continuously informed through the MI and CR Police centre on the learning fond of the CR Police Academy concerning EU problems and on prepared learning texts. This information can be found also on the Internet (Intranet) PA CR page. Ministry of Justice, MF - General Customs Directorate, BIS, UZSI, the Supreme Court of the Czech Republic, and the CR Highest state attorney office are informed in a parallel way also. These subjects and mainly their employees buy these textbooks and these learning texts.



SUMMARY


We can divide the process of Europeanisation at the Police Academy into three basic stages:

1. Realization of the original concept statement - the resolution of the Academic Senate of the Czech Police Academy of 30 March, 1998 which endorsed the document - "Participation of the Police Academy of the CR in preparation of the Ministry of Interior and the Police of the CR for the access to the European structures". On that basis the Police Academy will implement an effective teaching programme and draw up its own textbooks with a specialisation in justice and home affairs areas.
2. Europeanisation of teaching individual subjects relating to EC/EU law and European standards, which has applied particularly to the pedagogical staff. This stage likewise featured a programme implementation of Euro features by work on the theses and Bachelor written works.
3. The current phase represents the process of particular reflection of relevant EC/EU legal acts, other Union documents and Union standards into the draft subject questions and is focused especially on students. The parallel systematization of teaching the EU affairs does not represent a duplication of the European Law teaching, but its concrete manifestation and a completion following the Czech legal Code and therefore the direct projection of law and standards within the Union into existing conditions of the EU membership. Life-long education and a successive implementation of Euroaspects of particular material by drawing up or updating the textbooks belong to the forms of these activities.
